Terms of Service
The terms that govern your use of ThinkCollab.
Last updated:
1. The agreement
These terms are an agreement between you and Thinkster Creativity Nexus LLP (“ThinkCollab”, “we”, “us” or “our”), a Limited Liability Partnership registered in India (LLPIN ACE-8281) with its registered office at Flat No. F502 SNO 340/1, 2, Space Elena Patil Nag, Bavdhan, Haveli, Pune – 411021, Maharashtra, India. By creating an account or using ThinkCollab you accept them. If you use ThinkCollab on behalf of a company or agency, you confirm you are authorised to bind it, and “you” includes that organisation.
Our Privacy Policy and Cookie Policy form part of these terms.
2. What ThinkCollab is
ThinkCollab is a marketplace and set of collaboration tools that connect brands, creators and agencies: creator discovery and listings, collaboration requests, messaging, negotiation, contracts, invoicing and payment tools, and campaign reporting.
ThinkCollab is the platform, not a party to your collaborations. When a brand hires a creator, the resulting agreement is between the brand and the creator. We provide the tools — including contract templates and payment processing through third-party providers — but we are not an agent, employer, broadcaster or guarantor of either side.
3. Accounts and eligibility
- You must be at least 18 years old to use ThinkCollab.
- Account information must be accurate and kept current. One person may not hold an account for another person without authority to do so.
- You are responsible for what happens under your account and for keeping your credentials safe. Two-factor authentication is available and recommended.
- Workspace roles govern what members can do; the workspace owner is responsible for who it admits.
4. Creator listings and content
- Listings, metrics, portfolios and pricing must be truthful. Buying followers, fabricating engagement, or misrepresenting an audience is a ground for removal.
- You keep ownership of the content you upload. You grant us the licence needed to host, display and promote your listing on the platform — that is what publishing a listing means — and this licence ends for content you remove, except as retained in collaboration records.
- You must hold the rights to everything you upload. Do not publish content that infringes someone else’s rights or that shows people who have not consented.
- Metrics shown on listings are labelled by source. Platform-sourced metrics come from the connected account; manually entered metrics are marked as such and are not presented as verified.
5. Connected social accounts
- Connect only social accounts you own or are authorised to manage.
- Your use of Instagram remains governed by Meta’s own terms and policies; a connection to ThinkCollab does not change them.
- You can disconnect an account at any time, which deletes our stored access token — see the Data Deletion Instructions.
6. Collaborations, contracts and payments
- Collaboration requests, negotiated terms and contracts created on the platform are records of an agreement between the brand and the creator. Read them before you accept them.
- Payments are processed by third-party payment providers. We do not store card or bank credentials. Fees for using the platform, where they apply, are stated on the pricing page or in the contract flow before you commit.
- Invoices and payment records are retained as law requires, as described in the Privacy Policy.
- You are responsible for your own tax obligations arising from work booked through the platform.
7. Acceptable use
Do not:
- break the law, or use the platform to promote unlawful goods or services;
- impersonate a person or brand, or claim an audience that is not yours;
- harass, threaten or defraud other users;
- scrape the platform, probe or overload it, or attempt to access data or workspaces that are not yours;
- upload malicious code, or use the platform to distribute spam or deceptive content;
- circumvent fees by moving a platform-originated deal off the platform to avoid them.
8. Intellectual property
The ThinkCollab name, product and software are the property of Thinkster Creativity Nexus LLP and its licensors. These terms do not grant you any right to use our branding, and nothing here transfers ownership of either side’s intellectual property. Rights in deliverables created under a collaboration are whatever the brand and creator agree in their contract.
9. Third-party services
The platform integrates third-party services — including Meta platforms for Instagram connections and payment providers for payments. Those services belong to their owners and have their own terms. Instagram is a trademark of Meta Platforms, Inc.; ThinkCollab is an independent product and is not endorsed by, or affiliated with, Meta. We are not responsible for third-party services being available or fit for your purpose.
10. Disclaimers and liability
ThinkCollab is provided “as is” and “as available”. To the extent permitted by law, we disclaim implied warranties and do not promise that the platform will be uninterrupted or error-free, that any listing’s metrics are accurate beyond their stated source, or that any collaboration will succeed.
To the extent permitted by law, our aggregate liability to you for claims arising from the platform is limited to the greater of the fees you paid us in the twelve months before the claim, or ₹10,000. Nothing in these terms excludes liability that cannot be excluded under applicable law, including for fraud.
11. Suspension and termination
- You can stop using the platform at any time and delete your account as described in the Data Deletion Instructions.
- We can suspend or terminate an account that breaches these terms, creates risk for other users, or is required to be removed by law. Where reasonable, we tell you why and give you a chance to respond.
- Sections that by their nature survive — including intellectual property, disclaimers, liability and governing law — survive termination.
12. Governing law
These terms are governed by the laws of India. Subject to any mandatory law giving you rights elsewhere, the courts at Pune, Maharashtra have jurisdiction over disputes arising from these terms or the platform.
13. Changes to these terms
When these terms change we update the date at the top of this page, and for material changes we notify account holders through the platform or by email before they take effect. Continuing to use ThinkCollab after a change takes effect means you accept the updated terms. This document is provided for clarity and does not constitute legal advice.
